Section 106

The Section 106 process is triggered when federal funds are used (or federal licenses or permits are required) for a property listed, or eligible for listing, on the National Register of Historic Places. It involves two reviewing agencies instead of one: the State Historic Preservation Office (SHPO) and the Advisory Council on Historic Preservation, in Washington, D.C.

BCA submits, on behalf of clients, a package of proposed work to the SHPO, which in turn determines the effect of the work on the historic nature of the building. BCA advises clients on work that is likely to be cited as having an adverse effect, a determination that may complicate obtaining necessary permits and funding, and may delay construction efforts.
